UK starts final legislative step before ratification
The UK government has laid before Parliament the final piece of legislation needed before it can ratify the Unified Patent Court Agreement (namely, the Order on Privileges and Immunities). Equivalent legislation will be laid before the Scottish Parliament in due course. Both the Westminster and Holyrood orders will also require Privy Council approval.
In the meanwhile, the UPC’s Preparatory Committee announced on 7 June 2017 that the target date for launch of the UPC has slipped from December 2017. There is no information available yet on when the revised UPC launch date will be. However, a German constitutional complaint initiated recently is likely to delay German ratification significantly; launch of the UPC could be delayed until late 2018 or even into 2019.
