UPC expected to be operational in December 2017
The Unified Patent Court (UPC) is expected to be operational in December this year. A provisional timetable has been released by the Preparatory Committee. A number of factors could disrupt this timetable; these include when the necessary ratifications of the UPC Agreement and accession to the Protocol on Provisional Application take place. It is anticipated that the UK and Germany will both be in a position to ratify the UPC Agreement by April 2017.
The Privileges and Immunities Protocol
, a formal step in the process of UK ratification, was laid before the UK Parliament on 20 January. The purpose of the Protocol is to ensure the freedom of action of the UPC and the independence of their Judges and support staff.
The sunrise period is expected to start in September 2017. This is a minimum three month period when patent owners can opt out their European Patents from the jurisdiction of the UPC if they choose.
