EU Unitary Patent Package – who’s in
The Unified Patent Court (UPC) is a proposed common patent court open for participation of all member states of the European Union except for Croatia, Spain and Poland.
The Unitary Patent will be a pan-European patent across all 25 participating states. Currently, EU-wide protection is only available to those who validate a European Patent in each individual EU country, creating a ‘bundle’ of European rights. The Unitary Patent Court will hear cases regarding infringement and revocation proceedings of European patents (including unitary patents) valid in the territories of the participating states, with a single court ruling being directly applicable throughout those territories.
